<p>Sous le nom d&rsquo;infraction &laquo; mystique &raquo;, emprunt&eacute; &agrave; l&rsquo;anthropologie anglo-saxonne, ce sont les pratiques relevant de la sorcellerie -pour employer la terminologie courante- qui sont &eacute;tudi&eacute;es dans une premi&egrave;re partie : apr&egrave;s s&rsquo;&ecirc;tre interrog&eacute; sur l&rsquo;ambigu&iuml;t&eacute; du ph&eacute;nom&egrave;ne, apr&egrave;s avoir tent&eacute; de le d&eacute;finir et en avoir constat&eacute; l&rsquo;omnipr&eacute;sence malgr&eacute; certaines pratiques antidotiques (f&eacute;tichisme et divination), l&rsquo;auteur en d&eacute;crit des formes telles que les m&eacute;tamorphoses d&rsquo;hommes-animaux ou l&rsquo;anthropophagie. La seconde partie constate la difficult&eacute; d&rsquo;appr&eacute;hender ces ph&eacute;nom&egrave;nes sous un angle juridique : l&rsquo;incrimination de la sorcellerie remonte &agrave; la p&eacute;riode ant&eacute;rieure &agrave; la colonisation, avant de se d&eacute;velopper pendant la p&eacute;riode coloniale puis dans le cadre du droit moderne. La r&eacute;pression se heurte &agrave; l&rsquo;absence de d&eacute;finition.</p> <p><em>Abstract: Known as &ldquo;mystical&rdquo; offense, borrowed from Anglo-Saxon anthropology, it is the practices relating to witchcraft - to use current terminology - which are studied in the first part: after having questioned the ambiguity of the phenomenon, after having attempted to define it and having noted its omnipresence despite certain antidotic practices (fetishism and divination), the author describes forms such as the metamorphoses of animal-humans or anthropophagy. The second part notes the difficulty of apprehending these phenomena from a legal angle: the criminalization of witchcraft dates back to the period before colonization, before developing during the colonial period and then within the framework of modern law.
